1. Introduction

Welcome to Star Infomatic, a brand of Global Essentials. By accessing or using our services (hosting, domains, VPS, security, mail, etc.), you agree to be bound by these Terms & Conditions (“Terms”). Please read them carefully. If you do not agree, you should not use our services.

2. Definitions

“Company”, “we”, “us” or “our” means Star Infomatic, a brand of Global Essentials.
“Customer”, “you” or “your” means the person or entity who orders, pays for or uses our services.
“Services” means the products and services we provide (hosting, domains, VPS, dedicated servers, email, security, etc.).
“Agreement” means these Terms together with any service order, addendum, annexure, policy or other documentation provided by us.

3. Services & Order

When you place an order for Services, you represent that you are eligible to receive them under applicable laws and that you will comply with these Terms.
We may accept or reject your order at our sole discretion.
Upon acceptance and payment, we will provide you with access to the Services in accordance with the Service Level Agreement (SLA) and other applicable policy documents.

4. Payment & Billing

You must pay the fees for Services in advance (unless we agree otherwise).
We may charge you for setup, renewal, upgrades, add-ons, or other ancillary services if applicable.
All fees are non-refundable except as expressly provided in our Refund & Cancellation Policy.
If you fail to pay on time, we may suspend or terminate your Services.

5. Term & Termination

Services are provided for the term specified in the applicable order.
Either party may terminate the Services for cause if the other party breaches the Terms and fails to remedy the breach within a reasonable period.
Upon termination, you must pay any outstanding fees and we will cease providing the Services. We may delete or purge data according to our Data Retention Policy.

6. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with our Acceptable Usage Policy (AUP). Prohibited activities include (without limitation):

Sending spam or unsolicited messages.
Hosting illegal content or infringing intellectual property rights.
Attempting to gain unauthorised access to our systems or other users’ accounts.
Using excessive resources contrary to service specifications.

7. Intellectual Property

All intellectual property rights in and to the Services, documentation, software and infrastructure remain with us or our licensors.
You retain all rights in your data. By using the Services, you grant us a limited licence to process, store, transmit and backup your data as necessary to provide the Services.

8. Warranty & Disclaimers

We endeavour to provide reliable, secure services, but we do not guarantee uninterrupted or error-free service.
Except as required by law, we disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, our liability for any claim arising from these Terms or the Services is limited to the fees paid by you in the twelve (12) months preceding the claim.
We will not be liable for any indirect, special, incidental, punitive or consequential damages (including lost profits, loss of data or business interruption).

10. Indemnity

You agree to indemnify, defend and hold us harmless from and against all claims, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of your breach of these Terms, your use of the Services, or your violation of any rights of a third party.

11. Changes to Terms

We may modify these Terms from time to time. We will notify you of changes (e.g., via email or through our website). Your continued use of the Services after such changes constitutes acceptance of the modified Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute arising in relation to these Terms or the Services will be subject to the exclusive jurisdiction of the courts in [insert city/state], India.

13. Miscellaneous

If any provision is held invalid or unenforceable, the remainder of the Terms remains effective.
No waiver of any provision shall be deemed a further or continuing waiver.
